SALE FOR UNPAID RATES

In accordance with section 716(2) of Local Government Act 1993, Council is offering for sale by Private Treaty the following property:

OUTSTANDING MISCELLANEOUS DEBTS

Council records indicate that there are a number of outstanding small miscellaneous debts that despite numerous reminders remain unpaid. Council hereby gives notice that final notices will be forthcoming and that failure to respond will result in the commencement of debt recovery action. Should debt recovery action be commenced debtors will be liable for legal costs incurred in accordance with the Civil Procedure Act 2005.

However should you be experiencing financial hardship please contact Council immediately to formalise a payment arrangement.

REVIEW DRAFT DEVELOPMENT CONTROL PLAN NO 30 – EXEMPT AND COMPLYING DEVELOPMENT

Kempsey Shire Council has resolved to exhibit:

(a) Draft Development Control Plan (DCP) NO 30 relating to Exempt and Complying Development within the Shire;

The proposed changes are to ensure that where applicable, contributions are payable prior to release of Complying Development Certificates in areas where a contribution plan applies.

The draft DCP will be on exhibition at the Customer First Centre at Kempsey Shire Council for a period of 28 days from Tuesday 26 August 2008 finishing Tuesday 23 September 2008.

Any interested person may inspect the draft DCP at the above location during the exhibition period.

A copy of the draft DCP can be viewed at the Kempsey Library, South West Rocks Library, Stuarts Point Library and Hat Head Library during the library’s normal opening hours.

Submissions are to be made before 4.30pm on Tuesday 23 September 2008.

Please note that any submissions received will likely be produced in full in Council’s Business Paper and accordingly will be treated by Council as public information.

NEW FEES AND CHARGES (inclusive of GST) 1/7/08 to 30/6/09

Council at its meeting of 13 May 2008 adopted a schedule of fees and charges applicable from 1 July 2008 to 30 June 2009 as part of the 2008/2009 Management plan. A full copy of the fees and charges are available for perusal at Council’s Customer First Centre or on our website www.kempsey.nsw.gov.au, just go to “communications”, click on “ documents” and scroll down to “fees and charges”.

Proper sorting of the items listed as mixed waste, will, at the discretion of the gate staff, result in a nominal discount. The discount is based upon an assessment of the amount of materials sorted for re-use, compared to the overall volume of material being brought in. Volumes of material greater than those mentioned above will be charged the appropriate rate for large vehicles by weight across the weighbridge at the Crescent Head Road facility.

PROPOSED PUBLIC GATE

An application has been received from Mr Philip Salter as Director of Teamdate Pty Ltd to erect one (1) Public Gate, and one (1) Public Grid on Toose Road, at the boundary of:

WEED SPRAYING

Council wishes to advise that spraying will be undertaken for two (2) weeks from Monday 15 September – Friday 26 August 2008 at all sporting fields, parks and reserves for the control of broadleaf weeds, weather permitting. Council apologises for any inconvenience. Please contact Council’s Customer First Centre, on 6566 3200 if you have any concerns.

NOTIFICATION OF PUBLIC CONSULTATION – ALCOHOL FREE ZONES

The establishment of Alcohol Free Zones in public areas such as roads, public car parks and footpaths requires extensive public consultation to be undertaken with community members, licensed premises, NSW Police and the Anti-Discrimination Board.

Council has recently re-established Alcohol Free Zones established in Kempsey CBD, South Kempsey and West Kempsey residential areas.

Council is now looking to extend the network of Alcohol Free Zones to both Hat Head (Special Event) and West Kempsey CBD.

As part of the consultative process to see if there is sufficient warrant for the declaration of these zones it is proposed to hold public consultations.

The proposed consultations dates, times and locations are as follows:-

Hat Head - Tuesday, 2nd September 2008, 2.00pm - Hat Head Holiday Park Shelter Shed, Straight Street, Hat Head.

West Kempsey CBD – Thursday, 4th September 2008, 5.30pm – Kempsey Shire Council Chambers, Corner Elbow and Tozer Streets, West Kempsey.

If you are unable to make the consultations and would like to see where these zones may be implemented please contact our Customer First Centre on telephone 6566 3200 to arrange for a flyer to be sent out. Alternatively log onto www.kempsey.nsw.gov.au to identify which areas we are considering implementation of the zones.

Submissions on the proposed Alcohol Free Zone are invited and should be clearly marked “Alcohol Free Zone - including the zone you are wishing to comment on eg: Alcohol Free Zone - Hat Head ” and provided to Council in writing by close of business, Friday, 19 September 2008.
