Public exhibition - Kempsey Shire Council - Code of Meeting Practice
Council gives notice of its intention to adopt a revised ‘Code of Meeting Practice’.
The object of this code is to provide for the convening and conduct of meetings of Kempsey Shire Council and of Committees of Council, where all members are Councillors. The provisions of this Code are based on the provisions of Office of Local Government Model Code of Meeting Practice for Local Councils in New South Wales.
A copy of the draft practice is available for viewing at Council’s Customer Service Centre or on Council’s website. Enquiries regarding the draft procedure should be made to Council’s Manager Governance and Information Services, Daniel Thoroughgood on 6566 3338
Submissions relating to the revised draft practice are invited in writing addressed to the General Manager, Kempsey Shire Council, PO Box 3078 West Kempsey NSW 2440 or by email to ksc@kempsey.nsw.gov.au up until 4:30pm Tuesday 23 April 2019.
Submissions will be considered by Council at its 21 May 2019 meeting and please note that any submissions received may be reproduced in full in Council’s Business Paper and published on Council’s website and accordingly will be treated as public.
All submissions must be received before 4:30pm Tuesday 23 April 2019.
Kempsey Local Environmental Plan 2013 (Draft Amendment No. 27) ‘Housekeeping’ Amendments
Council has prepared a Planning Proposal to amend the Kempsey Local Environmental Plan (KLEP) 2013 (Amendment No. 27).
The Planning Proposal is a ‘Housekeeping’ amendment to:
- Remove an identified portion of the mapped urban release area within Urban Release Area Map Sheet URA_013B to enable the assessment of future development applications for dwellings/buildings within Stage 1 of the Malbec Part 3A approval (Saltwater Links Estate), otherwise prohibited by clause 6.3 of KLEP 2013;
- Amend zone and minimum lot size mapping in response to a Notice of Reservation issued under the National Parks & Wildlife Act 1974 and received from the Office of Environment & Heritage; and
- Amend building height, land zone and minimum lot size mapping for a small portion of R5-Large Lot Residential zone to standardise these values with the adjacent R1-General Residential zone in a single land parcel (currently the subject of a residential subdivision identified as the Seascape Grove Residential Estate, located at South West Rocks).
These housekeeping amendments apply variously to the following land:
- The Malbec Part 3A approval (Saltwater Links Estate): Portions of Lots 1 and 2 DP1229162, Belle O’Connor Street, South West Rocks (approximately 1.7ha);
- Limeburners Creek National Park: Lot 8, 108 & 186 DP754441 (approximately 471 hectares);
- Willi Willi National Park: Lot 42, 43 & 49 DP752424; Lot 1 DP594173; and Lot 113 & 114 DP752431 (approximately 198 hectares); and
- Seascape Grove Residential Estate: portion of Lot 332 DP1220901, Belle O’Connor Street, South West Rocks (approximately 2,200m²).
The Planning Proposal will be on exhibition from Tuesday 12 March until Tuesday 9 April 2019 and is available for viewing and downloading online at www.kempsey.nsw.gov.au/council/public-exhibition/index.html
Hard copies of the Planning Proposal will also be available from Council’s Customer Services Centre located at 22 Tozer Street, West Kempsey between 8:30am - 4:30pm Monday to Friday. Any interested person may inspect the Planning Proposal at the above location during the exhibition period.
Submissions to the Planning Proposal should address the General Manager and be emailed to ksc@kempsey.nsw.gov.au or posted in hard copy to Kempsey Shire Council, PO Box 3078, West Kempsey, 2440.
All submissions must be received before 4:30pm Tuesday 9 April 2019. Please note that any submission received by Council may be made publicly available.
A person who makes a written submission to a planning application is required to disclose all reportable political donations and gifts (if any) made by the person making the submission or any associate of that person within the period commencing two years before the submission is made and ending when the application is determined. Bitumen road construction and rehabilitation

Council’s sealed road renewal program is valued at $5.4 million this financial year and comprises 15 projects across the Shire, including sections of Armidale Road, Hat Head Road, Betts and Innes streets in East Kempsey and Marine Parade in Stuarts Point.
This week our crews will begin edge break repairs along Crescent Head Road as part of the bitumen road resealing and maintenance works. Crews will also continue edging, shoulder widening and subbase gravel work along Hat Head Road at Kinchela.
