PUBLIC EXHIBITION OF DRAFT KEMPSEY LOCAL ENVIRONMENTAL PLAN (KLEP) 1987 (AMENDMENT NO 100)

Proposed Rezoning of land known as No 19, Gregory Street, South West Rocks

Subject Land: Lots 233 & 317 DP 754396 Parish of Arakoon County of Macquarie.

Council resolved on 8 July 2008 to prepare a draft Local Environmental Plan (LEP) for the subject land to rezone the land. The purpose of the draft LEP is to rezone the land shown on the draft LEP Map from the current 5(a) Special Uses zone to part Zone 2(c) Residential and part Zone 7(d) Scenic Protection.

Exhibition Period

The exhibition period will be from Monday, 7 September 2009, to Friday, 6 November 2009.

Public Meeting

A public information evening will be held at the CWA Hall, 47 Landsborough Street, South West Rocks from 6pm to 8pm on Tuesday, 22 September 2009. Any interested person is welcome to attend.

Submissions to the draft LEP are to be addressed to the General Manager, Kempsey Shire Council, PO Box 78, WEST KEMPSEY NSW 2440 and are to be submitted no later than close of business on Friday, 13 November 2009.

PUBLIC EXHIBITION - DRAFT COMMUNITY DELIVERY PROGRAM 2010-2015

Council is preparing a Community Delivery Program that will be used as a strategic document outlining Council’s engagement approach in seeking to improve the wellbeing of our residents and providing platforms for community capacity building over the next five years.

The Kempsey Shire Council Community Delivery Program 2010-15 has been developed in accordance with the Local government (General) Amendment (Community and Social Plans) Regulation 1998.

Exhibition Document

The DRAFT Community Delivery Program will be on public exhibition for comments for a 28 calendar day period commencing on Friday 16 October 2009.

Submissions

Council welcomes any comments or suggestions on the DRAFT Program. Submissions are to be forwarded in writing to Council by 4.00pm Friday, 13 November 2009. Submissions can be mailed to Jo McGoldrick, Kempsey Shire Council, PO Box 78, West Kempsey, NSW 2440 or via email to ksc@kempsey.nsw.gov.au.

PRESENTATION OF FINANCIAL REPORTS AS PER SECTION 418(3) OF THE LOCAL GOVERNMENT ACT

In accordance with Section 418(3) of the Local Government Act, 1993, Kempsey Shire Council advises that the Ordinary Council Meeting to be held on 10/11/2009 will include the presentation of the audited Financial Reports and the Auditors Reports for the financial year ending 30/6/2009.

Submissions

Any person may make a written submission to Council during the public inspection period between 14 October 2009 and 20 November 2009, where a submission is by way of objection, the grounds of objection must be specified.

Any person who makes a submission by way of an objection and who is dissatisfied with the determination of Council to grant consent to the Development Application may appeal to the Land and Environment Court in accordance with Section 98 of the Environmental Planning and Assessment Act 1979.

A person or associate of the person who makes a submission in relation to the application must make a disclosure of any reportable political donation or gift made in the previous 2 years (and up to the time the matter is determined).

The disclosure (Disclosure Statement of Political Donations and Gifts) will need to accompany the submission.  A Disclosure Form and further details can be obtained from Council’s website www.kempsey.nsw.gov.au or at Council’s Customer First Centre.

Despite the provisions of the above, where a Commission of Enquiry is held the Ministers determination of the application is final and not subject to appeal.
