Development contributions plans
Development contributions help address the needs of a growing population.
Under the Environmental Planning and Assessment Act 1979 and the Local Government Act 1993, NSW councils can levy developers for contributions towards increasing public infrastructure or providing new facilities.
The contributions plans spell out how Council will assess, collect, spend and administer developer contributions.
Examples of infrastructure that can be funded by developer contributions include new or upgraded amenities, open space, community facilities and transport infrastructure.
Types of contribution plans
Section 7.11 plans
Under section 7.11 (formerly section 94) of the Environmental Planning and Assessment Act 1979, these contributions are typically levied on new residential and employment generating developments, including new dwellings, secondary dwellings such as granny flats, residential flat buildings and subdivisions.
Section 7.12 plans
Under section 7.12 (formerly section 94A) of the Environmental Planning and Assessment Act 1979, these contributions apply where the construction cost is more than $100,000 and where section 7.11 contributions are not required. They are typically applied to alterations and additions, including garages, sheds, and the demolition of an existing house and construction of a new house.
Section 64 plans
Under section 64 of the Local Government Act 1993, these plans are levied to fund water and sewer infrastructure directly related to a development, such as treatment plants and pump stations.
